Disney, Starz Sue Dish Network Over Free Channel Offer

Dish Network may have just settled with TiVo, but its lawyers won’t be resting anytime soon. The satellite company has just been hit by lawsuits from both Starz Entertainment and the Walt Disney Co. over the same promotional offer.

The offer in question was made when Dish raised rates for subscribers in February this year, but sweetened the deal by offering free access to different Starz and Encore movie channels – a contractual matter it didn’t run past Starz first. As a result, Starz is seeking a restraining order against Dish from offering any of its channels in violation of the existing agreement. Disney, meanwhile, is suggesting that Dish is infringing on its copyright by allowing access to its content outside its agreement with Starz, describing the free Starz channels as “unlawful distribution, transmission, copying and public display and/or performance.”

Both lawsuits point out that Starz previously issued a cease and desist to Dish Network that was ignored. In response to the lawsuits, Dish offered a statement that reads, in part, “Dish Network does not have visibility to the contract between Starz and Disney, but we will vigorously defend our rights against any attempt to drag our customers into the middle of their dispute.”
