		<description><![CDATA[The $39 billion merger between AT&#38;T and T-Mobile may still be going ahead, but it&#8217;ll have to face a lawsuit claiming unfair competition from Sprint and C Spire before it can be finalized, with a U.S. District Judge allowing the companies&#8217; case to proceed after dismissing some of their more outrageous claims. Judge Ellen Huvelle ruled yesterday that Sprint and C Spire (formerly Cellular South) could continue with their legal action against the merger, but limited the case to the effects the successful merger will have on the market share for mobile devices and, in C Spire&#8217;s case, the damage a merger would cause on the purchase of roaming service. (MORE: T-Mobile&#8217;s No-Contract 4G Android Phone Doesn&#8217;t Look Terrible) Unsurprisingly, with such a sensible and fair decision, both sides claimed victory. AT&#38;T general counsel Wayne Watts said that the company was pleased with the ruling and &#8220;believe the limited, minor claims they have left are entirely without merit.&#8221; Meanwhile, Sprint&#8217;s SVP of litigation, Susan Haller, announced her company&#8217;s pleasure, saying, &#8220;the Court has given us the chance to continue fighting to preserve competition on behalf of consumers and the wireless industry.&#8221; The next stage of the legal battle will be scheduled on December 9th. 		<description><![CDATA[Hoping to casually wander down to your local store tomorrow and pick up a new iPhone 4S without any hassle? That&#8217;s not likely to happen—nor is it looking like it&#8217;ll happen anytime soon, either. According to the websites of AT&#38;T, Verizon Wireless and Sprint Nextel, the new iPhone has sold out for immediate shipment. It&#8217;ll be interesting to see how much stock has been reserved for the phone&#8217;s retail launch tomorrow. Apple&#8217;s website lists the phone&#8217;s ship time at one to two weeks, regardless of the carrier. Both Sprint&#8217;s and Verizon&#8217;s websites show no remaining iPhone 4S stock available at all, while AT&#38;T&#8217;s site is now suggesting a delivery time of three to four weeks. (MORE: At Least One Million People Want Apple&#8217;s iPhone 4S) This shouldn&#8217;t come as a surprise; pre-orders for the new phone broke records last Friday, with one million people placing orders within 24 hours. Analyst Roger Entner, told Bloomberg that at least half of those who have pre-ordered are &#8220;Apple aficionados&#8221; who upgrade their iPhones with every release, with the remaining customers a mix of people upgrading from older models and those buying their first iPhone. &#8220;It looks like another blockbuster launch for Apple, only this time with three carriers,&#8221; he offered, adding that the new customers will help take America past an important milestone: &#8220;With this iPhone launch, we will have broken through the 50 percent penetration level [for smartphone usage in the U.S.]&#8220; Half of America&#8217;s cellphone users are now using smartphones? Clearly, this is the future. We&#8217;ll take a look at which carrier&#8217;s plans are best for cheapskates, big talkers, big texters, and those who want it all—voice, data and text messaging. (MORE: Spec Spat: Apple iPhone 4S vs. iPhone 4) Before we start, some constants between all three carriers: The iPhone 4S starts at $199 with a two-year contract. Voice plans include unlimited minutes to people on the same network, so even if you have the 450-minute plan on Verizon, for instance, you won&#8217;t use any minutes when calling other Verizon customers. Apple&#8217;s new iOS software features &#8220;iMessage,&#8221; which lets you send and receive free text messages (for now, at least) between other Apple devices that have the iMessage feature turned on as well. And with that, let&#8217;s get started. Cheapest Plan AT&#38;T: $40 for 450 voice minutes + $15 for 200MB data = $55/month Verizon: $40 for 450 voice minutes + $30 for 2GB data = $70/month Sprint: $80 for 450 voice minutes, unlimited texting and data AT&#38;T is the cheapest way to get into an iPhone, especially considering that if all you want is an iPhone—any iPhone—AT&#38;T&#8217;s the only carrier giving away the iPhone 3GS for free with a two-year contract. You give up text messaging with both AT&#38;T&#8217;s and Verizon&#8217;s cheapest plans. With AT&#38;T, you&#8217;ll pay 20 cents per text message (incoming or outgoing) and 30 cents per picture or video message (incoming or outgoing). Verizon charges 20 cents per text message (incoming or outgoing) and 25 cents per picture or video message (incoming or outgoing). As for data, with AT&#38;T you&#8217;ll pay $15 for another 200-megabyte bucket if you go over your initial 200 megabytes. With Verizon, you&#8217;ll pay $10 for an additional gigabyte after you go over your two-gigabyte allowance. 		<description><![CDATA[Sprint&#8217;s not being left out of the cheap iPhone party entirely, with the $99 iPhone 4 joining the iPhone 4S in the Now Network&#8217;s lineup. The 8 GB iPhone 4 is available for pre-order now from Sprint&#8217;s website. Pre-orders for the iPhone 4S begin on Friday. Sprint says it&#8217;s doing its best to deliver both models on October 14—the same day the new iPhone goes on sale in stores—or the day after. (MORE: Apple Announces iPhone 4S: Old Design, New Specs, Siri Assistant) As expected, Sprint will offer unlimited data with the iPhone, as it does with all other smartphones. Although pundits wondered whether demand for the iPhone would cause Sprint to crack down on data use, tiered data on Sprint always seemed like a longshot to me. Unlimited data is Sprint&#8217;s main competitive advantage against Verizon&#8217;s often-reliable 3G network and AT&#38;T&#8217;s superior HSPA+ data speeds. Without it, new smartphone buyers would have little reason to try Sprint instead of its two larger competitors. Unfortunately, it doesn&#8217;t look like Sprint is getting the iPhone 3GS, which AT&#38;T is now giving away for free with a two-year contract. This also isn&#8217;t a big surprise. Unlike the iPhone 4 and iPhone 4S, the 3GS was never designed to accommodate CDMA networks like those of Sprint and Verizon. (Verizon&#8217;s not getting the 3GS either.) At this point, prospective iPhone buyers should probably try to scrape together the extra $100 for an iPhone 4 anyway. It&#8217;s got a sharper display, a front-facing camera, a better rear-facing camera with flash and a faster processor, and it&#8217;ll likely get at least one more major software update beyond iOS5. Apple announced the iPhone 4S on Tuesday. It has the same design as the iPhone 4, but includes a dual-core processor, a faster 8-megapixel camera and Siri, a virtual assistant that responds to natural language. 		<description><![CDATA[With the Wall Street Journal reporting that Sprint essentially bet the company on the iPhone, it&#8217;s suddenly obvious why T-Mobile isn&#8217;t getting its own iPhone anytime soon. Sprint reportedly committed to purchase 30.5 million iPhones over the next four years&#8211;an estimated $20 billion value&#8211;whether consumers buy them or not. It&#8217;s a Hail Mary play intended to stop the company from shedding subscribers. (MORE: Sprint May Offer Unlimited Data Plans with iPhone 5) But T-Mobile, meanwhile, is working on a big play of its own: getting bought by AT&#38;T. As long as that acquisition&#8217;s on the table, there&#8217;s simply no way T-Mobile will stomach a long-term commitment to the iPhone like the one Sprint is making. It&#8217;s expensive, of course, but it also risks becoming redundant if the AT&#38;T deal goes through. I think there&#8217;s another reason at work here, alluded to last week by T-Mobile Chief Marketing Officer Cole Brodman. In a letter to customers explaining why T-Mobile isn&#8217;t getting the iPhone for now, Brodman offered what at the time seemed like boilerplate PR fluff. To wit: &#8220;In many ways, Android is rivaling and even outpacing the iPhone, including consumer adoption, market share and capabilities like support for faster 4G networks. Moreover, Android offers consumers the freedom of choice. You can choose from a variety of colors, screen sizes, slide-out keyboards, price points and customization options, as well as enjoy the numerous benefits of open source innovation, cloud services and amazing apps.&#8221; T-Mobile likes Android, having sold the first Android phones in the United States, and having used Android to roll out the first HSPA+ network in the United States. If T-Mobile made a deal with Apple like the one Sprint is making, it&#8217;d have to  place a huge emphasis on selling iPhones, to the exclusion of Android devices. By becoming another iPhone-centric carrier, T-Mobile would risk losing the qualities that make it unique. Today, Apple will announce its next iPhone, probably for AT&#38;T, Verizon and Sprint. Unfortunately for T-Mobile customers, it doesn&#8217;t look like that&#8217;s going to change anytime soon.<img alt="" border="0" src="http://stats.wordpress.com/b.gif?host=techland.time.com&#038;blog=5290478&#038;post=98812&#038;subd=timenerdworld&#038;ref=&#038;feed=1" width="1" height="1" />]]></description>

		<description><![CDATA[The Wall Street Journal is reporting that Sprint, the nation&#8217;s third largest wireless carrier, has agreed &#8220;to purchase at least 30.5 million iPhones over the next four years—a commitment of $20 billion at current rates—whether or not it could find people to buy them.&#8221; That&#8217;s according to oft-quoted &#8220;people familiar with the matter,&#8221; though both Sprint and Apple declined to comment. If true, it represents an enormous gamble for Sprint, but one the company apparently feels it has to make in order to compete with AT&#38;T and Verizon. Sprint CEO Dan Hesse reportedly said recently that the biggest reason people leave Sprint is because it doesn&#8217;t sell the iPhone. (MORE: Heads Up! Fake iPhone 5 Email Can Infect Your Computer) With the addition of the iPhone to its lineup, Sprint would have a key advantage over Verizon and AT&#38;T: unlimited data plans. Verizon offers between two and 10 gigabytes of data for between $30 and $80 per month, respectively, plus $10 per additional gigabyte in overage charges; AT&#38;T offers 250 megabytes or two gigabytes of data for $15 or $25 per month, respectively, plus $15 per additional 250 megabytes on the 250-megabyte plan or $10 per additional gigabyte on the two-gigabyte plan. Sprint, on the other hand, offers unlimited data and text messaging plans starting at $70 per month for 450 voice minutes. The company also has a $100-per-month plan that adds unlimited voice minutes. The supposed addition of the iPhone to Sprint&#8217;s lineup may not bear fruit until as late as 2014, reports by the Wall Street Journal. 		<description><![CDATA[Cellphone carriers in the U.S. are holding onto sensitive data about their customers for a significant amount of time, according to a Department of Justice memo that compares the data retention policies of four of the country&#8217;s largest carriers. Looking at the policies of Verizon, AT&#38;T, Sprint and T-Mobile, the memo reveals that while Verizon may be the worst offender for storing information in some respects—it keeps the IP Session and Destination information from your phone longer than the other carriers, as well as storing your text messages for five days (other carriers don&#8217;t store the content of messages at all)—it&#8217;s also the carrier that retains a list of your text recipients for the shortest amount of time (one year, compared with 18 months for Sprint, up to five years for T-Mobile and up to seven years for AT&#38;T). No Cell Phone Location Data) More importantly, Verizon is also the carrier that stores your cell-site data—tracking your movements via the location of the towers your cellphone is connecting to—for the shortest amount of time: one year, with T-Mobile storing it for a vague &#8220;year or more,&#8221; Sprint for up to two years, and AT&#38;T storing it indefinitely. The memo, dated August 2010 and marked &#8220;Law Enforcement Use Only,&#8221; was released by the American Civil Liberties Union of North Carolina following a Freedom of Information Act claim. 		<description><![CDATA[Sprint customers, rejoice! Okay, not quite yet: Sprint is due to make an announcement on October 7 that they’re adding 4G LTE services next year. If you&#8217;re not already streaming data effortlessly, CNET reports Sprint will flip the switch early next year, and that some customers may be able to get the service as early as the end of the first quarter in 2012. Still, it’s unclear how many markets the LTE launch would include. (MORE: Sprint May Offer Unlimited Data Plans with iPhone 5) According to reports, the wireless network is building its network and will begin testing it early next year as its Network Vision plan. If the rumors come to pass, Sprint may be adding the iPhone to its lineup as well, making for good times indeed. Verizon already has almost 160 cities that are LTE-equipped, while Sprint currently only offers 4G WiMax in 71 cities. AT&#38;T, comparatively, offers LTE in five cities but will expand into other markets. Sprint’s 4G WiMax was originally offered in partnership with Clearwire, but problems have prevented the expansion, thus forcing the network to deploy a brand new 4G network. 		<description><![CDATA[The idea of four-cents-per-megabyte 3G wireless data with no two-year contract might just be simple enough to work. And when I say &#8220;work&#8221; I mean both for consumers and for the company providing the service. Here&#8217;s the deal: This company, TruConnect, is offering access to Sprint&#8217;s nationwide 3G data pipe for $5 per month and 3.9 cents per megabyte. You&#8217;ll have to shell out for either a USB stick for your laptop ($70) or opt for the more practical, yet slightly more expensive MiFi router ($90) that allows you to connect up to five devices that have a Wi-Fi chip—that&#8217;ll basically cover any modern day connected device. (LIST: Tablets: &#8216;Why Should Somebody Buy This Instead of an iPad?&#8217;) After that initial financial outlay, you agree to pay $5 per month whether you use the service or not. Tough but fair? Tough but fair. When you do use the service, each megabyte will cost you 3.9 cents. Aside from that, there&#8217;s no two-year contract to get locked into. For comparison, AT&#38;T&#8217;s least expensive 3G data plan that works with the iPad runs $15 per month and gives you 250 megabytes to work with. Once you&#8217;ve used up all those megabytes, you&#8217;ll have to shell out another $15 for 250 more. Or you can pay $25 per month for two gigabytes (roughly 2,000 megabytes). This TruConnect deal would cost you $14.75 ($5 plus $9.75) and if you went over 250 megabytes, you&#8217;d still just pay 3.9 cents per additional megabyte used, instead of another $15 like you would with AT&#38;T. If you use a lot of data, however, this isn&#8217;t nearly as good of a deal at all. Under the same scenario as above, two gigabytes would cost you around $80 via TruConnect, but only $25 using AT&#38;T. So it could work out well for people who travel infrequently yet want access to nationwide 3G data sporadically, and it could work out well for TruConnect when some of those people end up using more data than they thought they would.
