		<description><![CDATA[&#8220;ReDigi 1.0 is dead &#8212; long live ReDigi 2.0 and beyond.&#8221; That&#8217;s what I wrote after ReDigi &#8212; a digital content exchange that allows you to purchase and resell digital music &#8212; lost an important legal battle against Capitol Records in late March. Capitol filed a complaint against ReDigi in New York in early 2012 for copyright infringement, alleging the company&#8217;s service was illegal on a variety of levels. ReDigi had argued that its version 1.0 technology, which let people upload to ReDigi servers and resell songs they&#8217;d purchased from iTunes, wasn&#8217;t copying, which would put it in violation of U.S. copyright law. The judge disagreed, writing in his ruling: &#8220;The novel question presented in this action is whether a digital music file, lawfully made and purchased, may be resold by its owner through ReDigi under the first sale doctrine. The Court determines that it cannot.&#8221; I spoke with ReDigi CEO John Ossenmacher shortly after the verdict about its ramifications for would-be digital resellers and what it means for ReDigi as a viable marketplace for used content rolling forward. Your reaction to the verdict? We all plan and we all think about what are the consequences or likely outcomes of things that might happen, and I have to say, one of the things we&#8217;re really grateful for&#8230; Our business was growing nicely before this verdict, but since it came out, we&#8217;ve been overwhelmed. Our system has almost gone down a couple times. We&#8217;ve been deluged with people not only wishing us well, but signing up and offering help. It&#8217;s been crazy. A lot of people who might not have otherwise know who you were. It&#8217;s like this whole unintended consequence of what happened. This ruling obviously has ramifications well beyond ReDigi. It&#8217;s not just music, it&#8217;s really digital everything, isn&#8217;t it? The future of how we think about digital artifacts in the U.S.? 		<description><![CDATA[You could see the aftermath of Sandy Hook coming a mile away: The National Rifle Association with its public relations engine spooling up like a pair of fighter jet turbines, its CEO Wayne La Pierre on the drama-infused defensive blaming everything but guns; the White House convening a &#8220;task force&#8221; to address the issue while reportedly prepping a slew of nearly 20 executive orders; video game pundits circling the wagons and penning the usual anti-anti-video-game screeds; millions of Americans turning to the media for explanations only to be greeted by misguided speculation, fact-starved &#8220;expert&#8221; commentary and at best, superficial analyses of the relationship (or lack thereof) between violence-in-media and why, among other things, the U.S. has the highest gun-related homicide rates of any developed country in the world. It&#8217;s all been pretty disconcerting to watch, and I don&#8217;t just mean the fanatical pro-gun proselytizing. I play video games for a living, and I&#8217;ve been writing and thinking about them for over a decade, studying the violence-in-media question and interviewing aggression researchers around the world. And while the research is clear that violent video games don&#8217;t incite people to pick up guns, strap on bulletproof vests and go on mass killing sprees, it&#8217;s wrong to assume we shouldn&#8217;t be asking and studying how changing media/mediums might affect us. So I cringe a little when I read stories where one side melodramatically absolves itself of any responsibility, while another pens acid rebuttals that amount to one-tenths evidence and nine-tenths snark. Chris Mooney&#8217;s &#8220;The Science of Why We Don&#8217;t Believe Science&#8221; is probably the single best piece I&#8217;ve read about why that may be. As Mooney notes, we&#8217;re inherently emotional creatures &#8212; so emotional that how we feel about something preempts conscious thought about it. We&#8217;re not driven only by emotions, of course—we also reason, deliberate. But reasoning comes later, works slower—and even then, it doesn&#8217;t take place in an emotional vacuum. Rather, our quick-fire emotions can set us on a course of thinking that&#8217;s highly biased, especially on topics we care a great deal<img alt="" border="0" src="http://stats.wordpress.com/b.gif?host=techland.time.com&#038;blog=5290478&#038;post=155087&#038;subd=timenerdworld&#038;ref=&#038;feed=1" width="1" height="1" />]]></description>

		<description><![CDATA[No, &#8220;six strikes&#8221; isn&#8217;t a phrase from some esoteric version of baseball played on Mars &#8212; it&#8217;s a colloquialism for a new anti-piracy warning system designed to track copyright infringers and help internet service providers (ISPs) take progressively punitive measures to discourage or prevent said infringers from engaging in further copyright-violating activities. It&#8217;s essentially an industry workaround, after SOPA and PIPA &#8212; bills designed to give the government increased power to battle copyright violators &#8212; failed or stalled last year. But &#8220;six strikes&#8221; is notably different from either SOPA or PIPA. For starters, it&#8217;s not a bill. Instead of empowering the government to blacklist sites deemed illicit, it&#8217;s an escalating warning system managed by ISPs independently. It employs a third-party tool, MarkMonitor, to identify users engaging in copyright-violating activities, then leaves it up to ISPs to take action. ISPs participating at this point include AT&#38;T, Verizon, Comcast, Cablevision and Time Warner Cable. Say an IP address associated with your account is identified as a violator. Your ISP would first send you a warning, then send further warnings for each infraction, at some point rolling out actual punitive measures, from throttling your bandwidth up to &#8212; in theory, a possibility &#8212; termination of your service. The system was supposed to go live this week, but was delayed at the last minute by the Center for Copyright Information (CCI), the group working with the Motion Picture Association of America, the Recording Industry Association of America and several of the nation&#8217;s biggest ISPs to roll &#8220;six strikes&#8221; out. According to CCI executive director Jill Lesser, the delay, due to &#8220;unexpected factors,&#8221; is mostly because of Superstorm Sandy, which &#8220;seriously affected&#8221; the group&#8217;s final testing plans. CCI says it now expects what it calls the &#8220;Copyright Alert System&#8221; to kick off in early 2013, adding: Our goal has always been to implement the program in a manner that educates consumers about copyright and peer-to-peer networks, encourages the use of legal alternatives, safeguards customer privacy, and provides an easy-to-use independent review program for consumers to challenge alerts they believe<img alt="" border="0" src="http://stats.wordpress.com/b.gif?host=techland.time.com&#038;blog=5290478&#038;post=152368&#038;subd=timenerdworld&#038;ref=&#038;feed=1" width="1" height="1" />]]></description>

		<description><![CDATA[All this year, and culminating in December at the World Conference on International Telecommunications in Dubai, the nations of the world will be negotiating a treaty to govern international telecommunications services between countries. It is widely believed that some countries, including Russia and China, will take the opportunity to push for U.N. control of Internet governance. If a previously published photo or record later proves to be embarrassing for the government, it is thrown down the hole.
